Terms of Service

Effective Date: January 1, 2026

These Terms of Service (“Terms”) govern your access to and use of the ScriptAssist website, forms, services, communications, and related offerings (collectively, the “Services”) provided by ScriptAssist, LLC (“ScriptAssist,” “we,” “us,” or “our”).

By using our website, submitting information to us, enrolling in our Services, or otherwise engaging ScriptAssist, you agree to these Terms. If you do not agree to these Terms, do not use the Services.

What ScriptAssist Does

ScriptAssist is a fee-based prescription affordability support and medication advocacy service. We help clients identify, research, prepare for, and navigate potential prescription savings opportunities, including patient assistance programs, copay support programs, charitable assistance resources, and other medication affordability options. ScriptAssist is not a pharmacy, insurance company, discount card program, drug manufacturer, healthcare provider, law firm, or financial advisor. ScriptAssist does not prescribe, manufacture, purchase, own, store, ship, dispense, or sell medications.

Any medication, discount, or assistance you may receive is provided by the applicable manufacturer, pharmacy, assistance program, foundation, insurer, or other third party, not by ScriptAssist.

 

No Guarantee of Eligibility, Approval, Savings, or Medication Access

ScriptAssist works to identify and pursue potential savings opportunities on your behalf. However, ScriptAssist does not guarantee:

  • eligibility for any program or assistance;

  • approval of any application;

  • access to any specific medication;

  • delivery of any medication;

  • any specific savings amount;

  • approval within any particular time period; or

  • continued eligibility, renewal, or ongoing assistance from any third party.

Eligibility and approval decisions are made solely by the applicable manufacturer, assistance program, copay program, charitable foundation, pharmacy, insurer, provider, or other third party.

 

Client Authorization

By enrolling in or using ScriptAssist’s Services, you authorize ScriptAssist to act on your behalf for the limited purpose of assisting with prescription affordability support, including researching options, communicating with applicable third parties, helping prepare documentation, following up on applications, and managing renewal or status communications related to those Services.

You authorize ScriptAssist to communicate, as reasonably necessary, with:

  • prescribing providers and their staff;

  • pharmacies;

  • pharmaceutical manufacturers;

  • patient assistance and copay support programs;

  • charitable foundations;

  • insurers or pharmacy benefit-related entities, where relevant; and

  • other parties reasonably involved in evaluating or processing assistance opportunities on your behalf.

If required, ScriptAssist may ask you to sign a separate authorization, consent, release, or other form for specific tasks or programs.

You may revoke your authorization to ScriptAssist at any time by providing written notice to us. Revocation will apply prospectively only and will not affect actions already taken before we receive and process your notice. If you revoke authorization, ScriptAssist may be unable to continue providing some or all Services.

 

Your Responsibilities

You agree to provide accurate, current, and complete information to ScriptAssist and to promptly update us if anything changes, including your medications, insurance, income, contact information, provider information, or other eligibility-related details.

You understand and agree that:

  • incomplete, inaccurate, or outdated information may delay or prevent ScriptAssist from helping you;

  • third-party programs may require documents, signatures, or follow-up from you or your provider;

  • delays by you, your provider, your pharmacy, or any third party may affect outcomes; and

  • ScriptAssist is not responsible for denial, delay, non-response, supply interruption, or termination caused by any third party.

 

No Medical, Legal, Insurance, or Financial Advice

ScriptAssist does not provide medical advice, diagnosis, treatment recommendations, legal advice, insurance advice, tax advice, or financial planning advice. Any information provided by ScriptAssist is for general support and administrative assistance only. You should consult your doctor or other licensed healthcare provider regarding your medical care, prescriptions, and treatment decisions. Do not stop, start, or change any medication based solely on information from ScriptAssist.

 

Fees and Billing

ScriptAssist is offered on a strictly monthly recurring service basis unless otherwise stated by ScriptAssist in writing.

Because ScriptAssist is a service-based business, fees are charged for the administrative, advocacy, coordination, research, enrollment, follow-up, and renewal support services performed on your behalf. ScriptAssist will not charge your account unless and until ScriptAssist confirms during the initial enrollment review that you are eligible for assistance with at least one medication or savings opportunity. Once eligibility is confirmed for at least one medication or savings opportunity, ScriptAssist may charge the initial monthly service fee and begin performing services on your behalf, including paperwork processing, coordination with relevant third parties, follow-up, and related support services. Thereafter, your payment method will be charged automatically on a recurring monthly basis on or about the same day of the month corresponding to your enrollment date, unless otherwise disclosed in writing.

You authorize ScriptAssist to charge your selected payment method for all applicable recurring monthly fees unless and until your Services are canceled in accordance with these Terms. If your payment method fails, is declined, expires, is revoked, or is returned unpaid, ScriptAssist may suspend or pause Services, retry payment, require an updated payment method, or terminate Services.

 

Cancellations and Refunds

Due to the service-based nature of ScriptAssist’s work, there are no refunds except as expressly stated in this section or as otherwise required by law.

If ScriptAssist determines during the initial enrollment review that we are unable to confirm eligibility for assistance with at least one medication or savings opportunity, there will be no charge to your account. If ScriptAssist confirms eligibility for assistance with at least one medication or savings opportunity, the initial monthly service fee may be charged immediately and Services may begin. If you do not receive assistance for a medication because you are determined to be ineligible by the applicable manufacturer, patient assistance program, copay program, charitable foundation, or other sponsoring organization, ScriptAssist will refund the monthly administrative service fee applicable to that medication for any affected month, provided that you supply written proof of denial from the applicable program or organization. You may cancel your authorization for ScriptAssist to act on your behalf at any time by providing written notice to ScriptAssist at support@goscriptassist.com.

Any cancellation or revocation will apply prospectively only and will not entitle you to a refund for:

  • services already performed;

  • fees already earned; or

  • the current billing period.

Cancellation of Services will stop future recurring charges after the current billing period, unless additional amounts are owed for prior failed or reversed payments.

 

Communications Consent

By providing your contact information, you consent to receive service-related communications from ScriptAssist, including by phone, email, text message, and voicemail, regarding your enrollment, account, payment, case updates, document requests, renewals, and related service matters. You represent that the contact information you provide belongs to you or that you are authorized to receive communications at that contact point. Message and data rates may apply for text messages depending on your carrier and plan. You may opt out of marketing communications at any time, but service-related communications may still be sent where necessary to provide the Services or administer your account.

 

Privacy and Security

ScriptAssist values your privacy and uses reasonable administrative, technical, and physical safeguards designed to protect the information you provide.

Sensitive information is encrypted as part of our efforts to help protect it from unauthorized access, misuse, loss, or disclosure. By using the Services, you acknowledge that ScriptAssist may collect, use, store, and share your information as described in our Privacy Notice and as reasonably necessary to provide the Services. No method of storage or transmission can be guaranteed to be completely secure, and ScriptAssist does not warrant absolute security.

 

Website Content and Intellectual Property

All content on the ScriptAssist website and in our materials, including text, graphics, branding, logos, layouts, forms, and other content, is owned by ScriptAssist or its licensors and is protected by applicable intellectual property laws. You may use the website and materials only for personal, non-commercial use related to learning about or using our Services. You may not copy, reproduce, modify, distribute, republish, scrape, frame, or exploit our content without prior written consent.

 

Prohibited Uses

You agree not to:

  • use the Services for any unlawful, fraudulent, or misleading purpose;

  • submit false, incomplete, or misleading information;

  • impersonate another person or misrepresent your authority;

  • interfere with the operation or security of the website or Services;

  • attempt unauthorized access to our systems or data; or

  • use the website or Services in a way that infringes the rights of ScriptAssist or others.

 

Third-Party Programs and Services

ScriptAssist may work with or refer to third-party manufacturers, charitable foundations, pharmacies, providers, insurers, and websites. ScriptAssist does not control and is not responsible for the acts, omissions, eligibility criteria, decisions, product availability, timelines, terms, or privacy practices of any third party.

Your interactions with any third party may also be governed by that third party’s own terms, policies, and requirements.

 

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

ScriptAssist disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.

Without limiting the foregoing, ScriptAssist does not warrant that:

  • the Services will meet your expectations;

  • savings opportunities will exist for your medications;

  • any application will be approved;

  • any medication will be delivered; or

  • the website or Services will be uninterrupted, secure, or error-free.

 

Limitation of Liability

To the fullest extent permitted by law, ScriptAssist and its owners, managers, officers, employees, contractors, agents, affiliates, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, opportunity, goodwill, data, or business interruption, arising out of or related to the Services, even if advised of the possibility of such damages. To the fullest extent permitted by law, ScriptAssist’s total liability for any claim arising out of or relating to the Services will not exceed the total amount actually paid by you to ScriptAssist during the three (3) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

 

Indemnification

You agree to defend, indemnify, and hold harmless ScriptAssist and its owners, managers, officers, employees, contractors, agents, affiliates, successors, and assigns from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your breach of these Terms;

  • your misuse of the Services;

  • your violation of applicable law;

  • your submission of false or inaccurate information; or

  • your infringement of another person’s rights.

 

Suspension or Termination

ScriptAssist may suspend, limit, or terminate your access to the Services at any time, with or without notice, if:

  • you violate these Terms;

  • you fail to provide required information;

  • payment is not received;

  • we believe continued service is not feasible; or

  • we determine, in our discretion, that continuing the relationship presents legal, operational, compliance, or safety concerns.

Sections that by their nature should survive termination will survive termination, including payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, arbitration, class-action waiver, and governing law.

 

Arbitration

Please read this section carefully. It affects your legal rights.

Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your relationship with ScriptAssist, or any aspect of your use of the Services shall be resolved exclusively by final and binding arbitration, rather than in court.

This arbitration provision shall be governed by the Federal Arbitration Act and shall survive termination of these Terms. The arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its applicable consumer arbitration rules, unless the parties agree otherwise. The arbitration may be conducted in Palm Beach County, Florida, or by remote proceeding if permitted by the applicable rules. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, enforceability, applicability, or formation of this arbitration agreement, except that a court of competent jurisdiction may determine issues relating to the enforceability of the class-action waiver below. Judgment on the arbitration award may be entered in any court having jurisdiction. Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction as necessary to protect rights or property pending completion of arbitration.

 

Class Action Waiver

To the fullest extent permitted by law, you and ScriptAssist agree that any dispute, claim, or proceeding shall be brought only in an individual capacity and not as a plaintiff, claimant, class representative, or class member in any purported class action, collective action, mass action, consolidated action, or representative proceeding. Unless both you and ScriptAssist agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not preside over any form of class, collective, mass, consolidated, or representative proceeding.

 

Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by the laws of the State of Florida, without regard to conflict of law principles. To the extent any matter is properly brought in court rather than arbitration, you and ScriptAssist agree to the exclusive jurisdiction of the state and federal courts located in Palm Beach County, Florida, and waive any objection to venue or inconvenient forum.

 

Changes to These Terms

ScriptAssist may revise these Terms from time to time. Updated Terms will be effective when posted on the website, unless another effective date is stated.

By continuing to use the Services after updated Terms are posted, you agree to the revised Terms.

 

Entire Agreement

These Terms, together with any enrollment forms, payment authorizations, consent forms, refund policy disclosures, and Privacy Notice referenced by ScriptAssist, constitute the entire agreement between you and ScriptAssist regarding the Services, except as otherwise agreed in writing.
